welcome to HalcoPay. these terms ("terms") govern your use of the HalcoPay marketing website at halcopay.com and the HalcoPay software you may download and deploy on your own infrastructure. by using the site or the software, you agree to be bound by these terms.
1. acceptance
by accessing the HalcoPay website, downloading the HalcoPay software, or using any service we provide, you accept these terms and any future modifications. if you do not agree, do not use the website or the software.
2. the software is self-hosted
HalcoPay is a self-hosted crypto payment processor. the software is publicly downloadable and deployed independently by you or by your organization on infrastructure you control.
we grant you a limited, non-exclusive, non-transferable, revocable license to use the software for its intended purpose, subject to the terms of the open-source license bundled with the source code.
once you have downloaded, modified, hosted, or operated the software, we make no representations or warranties, express or implied, about its integrity, security, availability, or fitness for any particular purpose. all liability arising from your operation of the software is disclaimed to the maximum extent permitted by law.
3. your responsibilities
you agree to use HalcoPay in compliance with all applicable laws and regulations of every jurisdiction in which you operate, including but not limited to:
- anti-money-laundering (aml) and counter-terrorism-financing (ctf) rules
- know-your-customer (kyc) requirements
- tax reporting obligations
- data-protection law (including gdpr and ccpa where applicable)
you are solely responsible for the security of the wallets, keys, and customer data held by your HalcoPay instance. you are responsible for keeping the software updated, applying security patches, and securing the underlying infrastructure.
4. privacy
your privacy matters. how we handle data on the HalcoPay website is described in our privacy policy. data collected by your self-hosted instance is governed by your own privacy notice, not ours.
5. intellectual property
the HalcoPay name, wordmark, logo, and visual identity are owned by HalcoPay or its licensors and are protected by trademark and copyright law. you may not use them to imply endorsement, partnership, or affiliation without our written permission.
the source code of the HalcoPay software is licensed under its bundled open-source license. nothing in these terms modifies that license.
6. limitation of liability
to the fullest extent permitted by law, HalcoPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of funds, loss of data, business interruption, or reputational harm — arising from:
- your use of, or inability to use, the website or the software
- any unauthorized access to or alteration of your self-hosted instance
- any bugs, errors, or omissions in the software
- price volatility of any cryptocurrency
- third-party services you choose to integrate
cryptocurrency is volatile and transactions are irreversible. you accept these risks when using HalcoPay.
7. third-party services
HalcoPay can integrate with third-party providers (for example block-explorer apis, exchange-rate feeds, or plugin authors). those providers operate under their own terms, and we are not responsible for their service, content, or actions.
8. changes to these terms
we may modify these terms at any time. material changes will be reflected by updating the effective date at the top of this page. your continued use of the website or the software after a change means you accept the revised terms.
9. termination
we may suspend or terminate your access to the website or to any commercial relationship with us at any time, with or without notice, for reasons including violation of these terms or applicable law. the open-source license bundled with the software is not terminated by this clause and continues to govern your right to run the code.
10. governing law
these terms are governed by the laws of the jurisdiction in which HalcoPay is incorporated, with respect to applicable consumer-protection provisions and data-protection law (including the eu gdpr and the california ccpa where they apply to your relationship with us). any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
